Mesothelioma legal issues

It's now widely recognized that there is a causal relationship between asbestos and mesothelioma; in fact, the first legal action in this regard was taken in 1929.

The basis of subsequent lawsuits has been that companies involved with asbestos knew of the potential dangers to workers who were exposed to asbestos, but did not take adequate steps to protect them.

As the medical evidence is now well established, the main task involves demonstrating willful negligence on the part of the employer. Many such cases around the world have been successful, with significant financial compensation being awarded.

One aspect to bear in mind is that because of the potentially long latency of the disease, decades may pass between the mesothelioma being contracted, and the symptoms becoming evident. This may be a hindrance in the prosecution of some cases.
